The use of the Application entails the collection and processing by the Company of certain personal data, which shall at all times be handled in accordance with Argentine Personal Data Protection Law No. 25,326, its Regulatory Decree 1558/2001, and other regulations issued by the National Directorate for Personal Data Protection.
For the purposes of these Terms and Conditions, "Personal Data" means any information relating to Users that allows their identification, whether directly or indirectly.
In addition to the registration data (indicated under the "Registration and User Account" section), the following Personal Data is collected through the Application: driving habits, geolocation, vehicle make and model, car insurance and insurance company, driving scores, trips taken, distances travelled, mobile device ID, and incoming call information.
Users expressly consent to their Personal Data being collected, stored, accessed, and shared by the Company as described in these Terms and Conditions.
The Company shall process Personal Data for the purposes of (i) enabling the User to use the Application; (ii) calculating the Score — as detailed in these Terms and Conditions; (iii) sending reports indicating the User's Score and describing the User's driving habits, including speeding, trip duration, phone use while driving, among other variables; and (iv) analysing trends, behaviour, driving patterns, and User interests for statistical purposes and to improve and enhance the Application's features. The Company may also send information or messages by email to Users about the Application and/or communicate, advertise, or offer products and/or services marketed or offered by the Company, its affiliates, subsidiaries, or associates, and/or third parties with whom the Company maintains business relationships. However, the User may at any time opt out of receiving such communications.
Personal Data collected by the Company through the Application shall be stored in a database owned by the Company and duly registered with the Agency for Access to Public Information.
The Company shall adopt the security and information preservation measures required by applicable regulations (including those contained in Resolution 47/2018 issued by the Agency for Access to Public Information) to ensure an adequate level of privacy and confidentiality of User data.
Users understand that if their User account is associated with a Fleet Manager User, their Personal Data and all account activity may be accessed by the Fleet Manager User.
Users may only use such information in accordance with the purpose for which it was collected as described in this document and/or for any other purpose to which the respective User expressly consents after having been provided with the legally required information.
Users may not disclose personal data of another User to any third party without the consent of the Company and the User who owns such data.
Users also consent to their Personal Data being shared with third parties as detailed in these Terms and Conditions, to the extent necessary for the development or fulfilment of the services provided through the Application.
All information and personal data collected from the User shall be hosted on the Company's servers provided by Google LLC, located at 1600 Amphitheatre Pkwy, Mountain View, United States of America.
Users agree that the recipients of their Personal Data may be located abroad, including in countries that — pursuant to Provision 60-E/2016 of the National Directorate for Personal Data Protection — do not ensure adequate levels of protection, and Users expressly authorise the international transfer of their Personal Data to such countries, in accordance with Article 12 of Decree 1558/2001.
Personal Data may also be disclosed to third parties under the following circumstances: (i) when there is a legal obligation to do so, and (ii) by order of a competent judicial authority.
In compliance with Resolution 14/2018 of the Agency for Access to Public Information, Users are informed that "The AGENCY FOR ACCESS TO PUBLIC INFORMATION, in its capacity as the Supervisory Authority of Law No. 25,326, has the power to hear complaints and claims filed by those whose rights have been affected by non-compliance with current regulations on personal data protection."
